These Terms of Service ("Terms") govern your access to and use of the RightDesk customer relationship management platform available at https://rightdesk.com (the "Service"), operated by Aluminum, Inc. ("RightDesk," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must provide accurate and complete information when creating an account and keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at contact@aluminum.io if you become aware of any unauthorized use of your account.
If you are an account administrator for an organization, you are responsible for managing access permissions and all data within your organization's account. You are responsible for ensuring that users you grant access to comply with these Terms.
RightDesk provides a customer relationship management platform that allows users to manage contacts, communications, calendar events, and related data.
RightDesk is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue any part of the Service at any time without liability.
The Service is currently offered free of charge. We reserve the right to introduce paid features or plans in the future, with reasonable notice to existing users.
The Service allows you to connect third-party accounts, including Google Gmail, calendar, and contact services, to enable CRM functionality such as viewing email communications, syncing contacts, and displaying calendar events within RightDesk.
By connecting a third-party account, you authorize RightDesk to access and use data from that account solely to provide the CRM features you have enabled. Your use of third-party services remains subject to those providers' own terms and policies.
RightDesk's use and transfer of information received from third party APIs will adhere to the third party API services user data policies, including any limited use requirements.
RightDesk is not responsible for the availability, accuracy, or performance of any third-party service. Changes to third-party APIs or policies may affect the functionality of integrations, and RightDesk shall have no liability for any resulting disruption or loss of functionality.
You retain all ownership rights to the data you input into the Service ("User Data"). By using the Service, you grant RightDesk a limited, non-exclusive license to use, process, and store your User Data solely as necessary to operate and provide the Service to you.
RightDesk and its licensors retain all rights, title, and interest in and to the Service, including all software, designs, trademarks, and other intellectual property. Nothing in these Terms grants you any right to use RightDesk's branding or intellectual property except as needed to use the Service.
You agree not to use the Service to:
We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms.
You may terminate your account at any time by contacting us at contact@aluminum.io.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.
Upon account termination, or upon disconnection of a third-party account, associated data will be deleted within 30 days, unless retention is required by law or necessary for a documented security or legal matter. Please refer to our Privacy Policy for further details on data retention.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RIGHTDESK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIGHTDESK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
RIGHTDESK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY YOU TO RIGHTDESK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless RightDesk, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any data or content you submit to the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of California, and you consent to the personal jurisdiction of such courts.
We may update these Terms at any time. Changes are effective immediately upon posting the revised Terms on the Service. The "Effective Date" at the top of these Terms will be updated accordingly. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and RightDesk regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
The failure of RightDesk to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. RightDesk may assign its rights and obligations without restriction.
